Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and MindMatch ("we", "us", or "our") governing your use of the MindMatch mobile application and related services (collectively, the "Service").

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the app or push notification.

2. Eligibility

• You must be at least 17 years old to use MindMatch.
• You must be able to form a legally binding contract in your jurisdiction.
• If you are using MindMatch on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
• MindMatch is not available to users who have previously been banned or removed from the Service.

3. Your Account

You must sign in using a valid Google account to use MindMatch. By signing in, you:

• Represent that all information you provide is accurate, current, and complete
• Are responsible for maintaining the security of your account
• Agree to notify us immediately of any unauthorized use of your account
• May only maintain one account per person

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts at our discretion.

4. Acceptable Use

You agree to use MindMatch only for lawful purposes and in a manner consistent with these Terms. You agree to:

• Provide accurate profile information
• Treat other users with respect
• Only contact users who have matched with you or who have opted to receive your messages
• Comply with all applicable laws and regulations

5. Prohibited Conduct

You may not use MindMatch to:

• Impersonate any person or entity, or falsely represent yourself
• Harass, bully, threaten, or stalk other users
• Post explicit, offensive, or harmful content including nudity, violence, or hate speech
• Spam other users with unsolicited messages
• Scam or defraud other users (e.g., soliciting money, promoting pyramid schemes)
• Distribute malware or any code that could damage the Service or other users' devices
• Scrape or harvest user data using automated tools
• Attempt to reverse engineer or hack the application
• Create fake profiles or misrepresent your identity
• Violate the privacy of other users (e.g., sharing their personal information without consent)
• Use the Service for commercial solicitation or advertising
• Use the Service if you are a registered sex offender

6. User Content

6.1 Ownership

You retain ownership of all content you create and upload to MindMatch, including your profile photos, voice messages, and text messages ("User Content").

6.2 License to MindMatch

By uploading User Content, you grant MindMatch a non-exclusive, royalty-free, worldwide license to store, display, and transmit your content solely for the purpose of operating and providing the Service. This license ends when you delete the content or your account.

6.3 Content Standards

User Content must not:

• Be illegal, defamatory, obscene, or infringe on any third party's rights
• Contain nudity, graphic violence, or sexual content
• Contain personal information of other individuals without their consent
• Contain malware or malicious code

6.4 Our Right to Remove Content

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to our users or the Service, without prior notice.

7. Matching and Communications

• MindMatch connects users based on shared mind map topics. We do not guarantee that you will find a match or that any match will lead to a meaningful connection.
• We are not responsible for the conduct of other users within or outside the Service.
• Never share sensitive personal information (home address, financial information, passwords) with other users.
• Exercise caution when meeting people you have connected with online.

8. Intellectual Property

All MindMatch branding, design, code, mind map interface, algorithms, and other materials (excluding User Content) are the exclusive property of MindMatch and are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer any part of the application.

9. Third-Party Services

MindMatch uses third-party services including Google Sign-In, Google Firebase, and Supabase. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services or their practices.

10. Termination

You may terminate your account at any time by deleting it through the app (Settings → Delete Account).

We may suspend or terminate your access to MindMatch immediately, without prior notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The Service is free of viruses or other harmful components
• Results obtained from using the Service will be accurate or reliable

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINDMATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST 12 MONTHS (WHICH, FOR A FREE SERVICE, IS $0).

13. Indemnification

You agree to defend, indemnify, and hold harmless MindMatch and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
